Terms of Service

Momochi (“Momochi,” “we,” “us”) operates the Momochi app and website (the “Service”). These Terms of Service (“Terms”) govern your access to and use of the Service. By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. Who can use Momochi

You must be at least 13 years old to use Momochi. You must provide a phone number you control to verify your account, and you’re responsible for all activity under your account. You may not create an account for anyone other than yourself, or share your account credentials.

2. What Momochi does

Momochi lets people build a crowd-sourced, dish-level menu for real-world restaurants: you photograph a restaurant’s menu while physically on site, and our systems (including automated AI processing) transcribe it into structured menu items. You can then post photos, ratings, and comments about specific dishes. Restaurant listings come from third-party map data (currently Overture Maps) and reflect real, existing places — you may not add a restaurant that doesn’t exist or isn’t open to the public.

Menu photos you upload are used to build the structured menu and are not shown to other users. Dish photos, ratings, and comments you post are shown publicly on the restaurant’s page unless we remove them.

3. Location and on-site scanning

Scanning a menu requires your device’s precise location so we can confirm you’re physically at the restaurant. We use location only for this verification and related anti-abuse checks, and as described in our Privacy Policy.

4. Your content

You keep ownership of the photos, ratings, comments, and other content you submit (“User Content”). By submitting User Content, you grant Momochi a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, cropping or compressing an image, or extracting text from a menu photo via AI), display, and distribute it in connection with operating and promoting the Service.

You’re solely responsible for your User Content. You confirm that you have the right to post it, that it doesn’t infringe anyone else’s rights, and that it’s accurate to the best of your knowledge.

5. Community standards and moderation

Don’t post content that is illegal, harassing, hateful, sexually explicit, deliberately false, or that misrepresents a menu, dish, or restaurant. Don’t impersonate others, manipulate ratings, scrape the Service, or interfere with its normal operation.

Content may be reviewed by automated systems and, when flagged by other users or those systems, by a human moderator. We may remove content, restrict features, or suspend or terminate accounts that violate these Terms, at our discretion.

6. Accuracy of menu and dish information

Menu items, prices, descriptions, nutrition estimates, and translations shown in the Service are generated from user-submitted photos using automated AI processing and community contributions. They may be incomplete, outdated, or inaccurate. Momochi is not a substitute for checking directly with the restaurant, particularly for allergens, dietary restrictions, or pricing.

7. Third-party services

The Service relies on third parties to operate — for example, phone verification, AI processing of menu and dish content, authentication providers, and cloud hosting. Your use of features built on those services may also be subject to that provider’s own terms.

8. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Momochi is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on menu, pricing, nutrition, or dish information. Our total liability for any claim relating to the Service is limited to the amount (if any) you paid us in the 12 months before the claim arose.

9. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.

10. Governing law

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you through the Service before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
